Time limits apply in California
Missing a deadline can end a claim. The most common ones:
Start free case review- 2 years from the injury to file most personal injury lawsuits (Code of Civil Procedure § 335.1).
- 3 years for most property damage claims, such as damage to your vehicle (CCP § 338).
- 6 months to file a claim when a city, county, state agency or public bus is involved (Government Code § 911.2).
- 10 days to file an SR-1 report with the DMV when there is an injury, a death, or more than $1,000 in damage.
Exceptions exist, for example for minors and delayed discovery. Deadlines depend on your facts, so don't wait to get advice.

How long do I have to file a personal injury claim in California?
For most personal injury lawsuits, 2 years from the date of injury (CCP § 335.1). Property damage claims generally have 3 years. If a government entity is involved, a claim usually must be filed within 6 months. There are exceptions, so get advice early.
What if I was partly at fault?
California uses pure comparative fault. You may still recover damages, reduced by your share of fault.
